How Do I Get the H-1B Visa?

 


The H1B Visa is an immigrant visa under the Immigration and Nationality act, section 101 which allows U.S. businesses to temporarily hire foreign nationals in specialty occupations for a specific period of time. These are usually referred to as the 'skilled worker' visa. While many applicants apply for these visas, it can be difficult to qualify if you do not have a high school diploma or a college degree.

You must first have a job and you must have a job that is related to your field of study. Most employers prefer to hire qualified candidates with relevant qualifications. To qualify for the visa, you must be employed at least two months during the year for at least the past three years in your own country. There are different programs that a company can take to help their employee gain permanent residency status on the visa.

If you have no job or work experience, you can still qualify. Most companies only require you to have an active bank account. You can also have a degree if the employer chooses to view it. This is one reason why many people don't think about applying because they feel they don't have a chance.

You must also have a high school degree from an accredited institution. You must have at least one year of study and you must be able to prove that this was paid by federal or state funds. You will need a copy of your graduation or transcript or a statement from your school stating that your transcript or diploma was received from a school that is recognized by the Department of Education.

Another factor you will need to consider when filing for the visa is your educational level. If you are applying to work as a nurse then you will need to have a bachelor's degree or higher and most likely your educational degree must be from an accredited university or college. A master's degree is usually required for an entry level position in the medical field.

However, if you don't work in a specialty occupation and you don't have any experience, you won't be accepted. Keep in mind though, that if you are unable to work in your specialty then you can still apply for a temporary work permit and get the visa.

While the H-1B Visa does not allow you to work while you are in the United States, it does have certain job requirements. You must meet all of these requirements to be considered for the visa.

It is important that you understand your rights and what your company needs before signing on the dotted line. Don't hesitate to ask questions because this will make things easier down the road.
